The following actions are explicitly forbidden in relation to your username and password used to access the Services:
If you forget your username or password, the Services will send your username or a temporary password to an email address you previously provided. You acknowledge that any other individuals using the same email address may access your Service account information, but only if they correctly answer your security questions.

You commit to not using the Services for any other intent, including commercial activities, such as co-branding, framing, linking, or reselling any segment of the Services without our prior written approval.
You may access, download, or print materials available through the Services solely for noncommercial and personal use and within the boundaries permissible by this Agreement. Any other utilization of these materials can only be made with the express written consent of Sohar Health.
Unauthorized use of any words or images from the Services could potentially infringe copyright laws, trademark laws, privacy and publicity laws, and could lead to civil and criminal penalties.
The Services include materials that are wholly or partly derived from copyrighted materials, encompassing the format and layout of the Services. The copyrights are owned either by Sohar Health, or, in the case of licensed content, the content providers.
No names, trademarks, service marks, and logos of Sohar Health appearing on the Services can be used in any advertising or publicity, or in any other way to indicate Sohar Health’s sponsorship of or affiliation with any product or service, without explicit written permission from Sohar Health. Nothing within the Services should be interpreted as implicitly, by estoppel, waiver, or otherwise, granting any license or usage rights to any trademark displayed on or via the Services, without written permission from Sohar Health or the third-party owner of the trademark, if there is one. The Services may display other proprietary notices and copyright information, the conditions of which you must adhere to and respect.
Sohar Health reserves the right to modify this Agreement at any given time. Any modifications to this Agreement will be enforced immediately once the revised terms and conditions are posted on the Service. It’s your responsibility to periodically check these terms and conditions. Your sustained usage of the Services post any modifications signifies your consent to comply with and be bound by the updated Agreement.
It is your responsibility to procure, install, maintain, and operate all necessary software, hardware, or other equipment required for you to access and use the Services. This includes, but is not limited to, using up-to-date web browsers and the finest commercially available encryption, antivirus, anti-spyware, and internet security software. You are also in charge of securing Internet services from your chosen Internet service provider, and you’re responsible for any fees that the Internet service provider or any related communications service provider may levy. This includes any implied warranties of merchantability, suitability for a specific purpose, and non-infringement. The use of the Services is at your sole risk. There may be interruptions in access to the Services, and the information, services, and materials may not be free from errors. Neither Sohar Health, its suppliers, nor any other party involved in the creation, production, or delivery of the Services or the information, services, and materials contained therein, take on any liability or responsibility for the accuracy, completeness, or utility of any information, services, and materials provided on the Services. They shall also not be liable for any direct, indirect, incidental, special, exemplary, consequential, or punitive damages resulting from your use of, or inability to use, the Services for any reason. By using the Services, you acknowledge and agree that the above limitations are essential elements of this agreement, and without such limitations, the Services would not be provided to you. Please be aware that some jurisdictions may not allow the exclusion of implied warranties, so some of the above exclusions may not be applicable to you.
You commit to protect, defend, and indemnify Sohar Health, its suppliers, and their respective affiliates, employees, officers, directors, agents, servants, and representatives from any liability, loss, claim, lawsuit, damage, and expense related to your breach of this Agreement, your utilization of the Services, and your posting of content to the Services.
By using the Services, you absolve and permanently release Sohar Health, its officers, employees, agents, successors, and assigns from any past, present, or future disputes, claims, controversies, demands, rights, obligations, liabilities, actions, and causes of action of every kind that have arisen or may arise directly or indirectly from the Services. If you are a resident of California, you voluntarily relinquish your rights under California Civil Code Section 1542, which says: “A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release, which if known by him or her, must have materially affected his or her settlement with the debtor or released party.”
The interpretation of this Agreement, as well as the settlement of any disputes that arise from it, shall be governed by the laws of the State of Delaware. Any disagreements between Sohar Health and you concerning this Agreement will be exclusively resolved by the state and federal courts located in Delaware.
The Services are accessible from various locations across the United States and globally. Considering that each state or country may have different laws, you agree that the laws of the State of Delaware, disregarding any conflict of law principles, will govern all matters related to the use of the Service.
Any disagreement, claim, or controversy that originates from or relates to the Services or this Agreement, including its termination, enforcement, interpretation, or validity, as well as determining the scope or applicability of this agreement for arbitration, will be resolved by arbitration in San Francisco, California with three arbitrators. The American Arbitration Association will administer this confidential, final, and binding arbitration according to its current rules and procedures.
Any decision or award resulting from such an arbitration process will be documented, explaining all conclusions of law and fact, including the assessment of costs, expenses, and reasonable attorney’s fees. The judgment on the award can be entered and enforced in any court with jurisdiction. If a party fails to proceed with arbitration, unsuccessfully contests the award, or fails to comply with the award, the other party has the right to recover costs of the suit, including a reasonable attorney’s fee for having to compel arbitration or defend or enforce the award.
The parties agree to engage in arbitration strictly on an individual basis, excluding any collective arbitration. Any claims arising from or related to this Agreement, the website, or the relationship between the parties should be individually pursued, and neither party shall participate in any class or collective action.
If any part of this Agreement is found to be invalid or unenforceable, that section is considered severed and the rest of the Agreement will continue to be fully valid and enforceable.
Sohar Health retains the authority to close accounts for any reason it finds suitable, including suspicions that your actions or your usage of the Services infringes applicable laws or negatively impacts the interests of Sohar Health or other users. Sohar Health may also set boundaries on, alter, suspend, or discontinue the Services in general, and can suspend or terminate your usage of the Services if you fail to abide by this Agreement. Such suspension or termination might erase your data, files, and previously accessible content. If Sohar Health discontinues the Services or your usage of them, this Agreement will also be terminated, but Clauses 2 through 17 shall persist in effect post the termination of this Agreement.
In the absence of a separate written contract with Sohar Health regarding the Services, these Terms of Service and Privacy Policy (including any documents expressly referred to within these Terms of Service) form the complete agreement between you and Sohar Health concerning the Services, superseding any previous agreements. If there is a discrepancy between this Agreement and a signed written contract between you and Sohar Health related to the Service, the provisions of this Agreement will prevail.
This Agreement is specific to you, and you cannot assign, transfer, or sublicense it without our prior written approval. We reserve the right to assign, transfer, or delegate any of our rights and obligations under this agreement without requiring your consent.
If any clause of this Agreement is deemed invalid, unlawful, or unenforceable, the remaining clauses of the Agreement will still be in full effect, provided that the essential terms and conditions of this Agreement remain valid, binding, and enforceable, and the legal and economic essence of the transactions contemplated by the Agreement is substantially maintained.
US export control laws govern the export and re-export of technology originating in the US, including the electronic transmission of information and software to foreign countries and certain foreign nationals. You agree to comply with these laws and their regulations. Nothing in this agreement establishes an agency, partnership, or joint venture. The failure to enforce any provision will not amount to a waiver of that provision.
